1. Copyright Infringement Notification

IdeaPulley respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our Service.

If you believe that your copyrighted work has been copied, displayed, or distributed in a way that constitutes copyright infringement, please notify our designated Copyright Agent with the following information:

Required Information (DMCA Notice):

  1. Your physical or electronic signature (typing your full name constitutes an electronic signature).
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are covered, a representative list of such works.
  3. Identification of the material that is claimed to be infringing, including information reasonably sufficient to locate the material (e.g., the URL or specific location on our Service).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

2. Counter-Notification

If you believe that your content was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification with our Copyright Agent. To be effective, your counter-notification must include:

Required Information (Counter-Notice):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where the material appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal court in San Francisco, California, and that you will accept service of process from the person who provided the original DMCA notification or that person's agent.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.

3. Repeat Infringer Policy

IdeaPulley maintains a policy of terminating accounts of users who are repeat infringers of copyright. We reserve the right to terminate accounts that receive multiple DMCA takedown notices.

4. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be held liable for damages (including costs and attorney's fees) incurred by the alleged infringer, any copyright owner, or us.

5. User Content Responsibility

Users are solely responsible for ensuring that any content they upload, submit, or share through the Service does not infringe upon the intellectual property rights of third parties. IdeaPulley acts as a neutral platform and does not pre-screen user content.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDEAPULLEY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO DMCA TAKEDOWNS, COUNTER-NOTICES, OR COPYRIGHT DISPUTES, INCLUDING BUT NOT LIMITED TO: LOSS OF CONTENT, ACCOUNT TERMINATION, LOSS OF REVENUE, OR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES.

Users who submit DMCA notices or counter-notices agree to indemnify and hold harmless IdeaPulley against any and all claims, damages, costs, and expenses (including attorney's fees) arising from such notices.

7. Non-Disparagement

Users agree not to publicly disparage IdeaPulley regarding any DMCA action, takedown, or dispute. Any such statements may result in account termination and legal action for damages.

9. Other Rights

Nothing in this DMCA Policy limits IdeaPulley's right to remove or disable access to any material that we believe may be infringing, regardless of whether a formal DMCA notice has been submitted.
